Swine Farm Siting Act Ammends

H822 removes the requirement that neighbors on adjacent property must consent in order to allow the rebuilding of non-confirming or modification of structures. In essence this will allow inappropriately sited structures to remain in place permanently. Owners of swine operations can seek multiple variances over time, which is counter to the path that, under two governors, North Carolina has followed: namely, converting existing operations to environmentally advanced systems.
The Swine Farm Siting Act, as originally enacted, protects both the industry and the property rights of neighbors. Yet the people most directly affected by the changes, the neighbors of these operations, will have no opportunity to comment.
